1. Controller

The controller within the meaning of the EU General Data Protection Regulation (GDPR) is:

Kilian Gagliotta-Damelang
c/o Online-Impressum #5903
Europaring 90
53757 Sankt Augustin
Germany

E-mail: tauschbuchsupport@gmail.com

2. General principle of data processing

“Tauschbuch” is an Android app that works locally.

During ordinary use of the app, no personal data is transferred to the provider. The app does not establish any connection to servers of the provider.

In particular, the app contains:

The provider only processes personal data if you voluntarily contact the provider by e-mail. Further information can be found in section 10.

3. Local data storage

All content that you create or save in the app is stored locally in the app’s protected storage area on your Android device.

This may include in particular:

The provider has no access to this data. The locally stored content is not transferred to servers of the provider and cannot be viewed, edited or deleted by the provider.

You can view, change and delete the content stored within the app yourself.

Please store personal data of other persons only if you are entitled to store and use it.

4. Photos

The app allows you to take photos or select existing photos via the selection function of the Android operating system, for example to document a trade or an item.

Photos are only accessed when you actively use the corresponding function.

When you select an existing photo, the app only receives access to the image you have selected. General or permanent access to your entire photo gallery is not intended.

New photos are taken via the operating system’s camera app. The app itself does not require any camera permission for this.

Selected or captured photos are stored locally in the app’s storage area. Photos are not transferred to the provider or to services operated by the provider.

5. JSON backup and restore

The app allows you to export the data stored within the app as a JSON file and to import it again later.

Export and import take place exclusively at your own initiative.

When exporting, you choose the storage location yourself via the file selection dialog of the Android operating system. When importing, the app only receives access to the JSON file you have selected.

A JSON backup file may contain all content you have stored within the app and therefore also personal data.

The provider has no access to exported or imported backup files.

6. Creation and export of PDF files

The app enables you to compile contact details stored within the app into a PDF document and export it.

The PDF file is created locally on your Android device. The data it contains is not transferred to the provider or to any online service used by the provider during creation.

Depending on the selected content, the PDF file may contain in particular:

PDF files are created exclusively at your own initiative. You decide which data the PDF file contains and where the file is stored.

The provider has no access to the PDF files you create.

7. Choice of storage location and external storage services

You choose the storage location for JSON backups and PDF files via the file selection dialog of the Android operating system.

Depending on the apps and services installed on your device, you can store files for example:

If you select a cloud storage or another external storage service, the file is transmitted to that service. Further storage and processing are then governed by the privacy policy of the provider you have selected.

The provider of the “Tauschbuch” app has no influence on the storage location you select and no access to the files stored there.

If you subsequently open, copy, send or share a JSON or PDF file via another app, that external app may gain access to the content of the file. Further processing is governed by the privacy policy of the respective provider.

You are responsible for the secure storage, use, disclosure and deletion of exported JSON and PDF files.

As these files may contain personal data, they should be protected against unauthorised access and only shared with authorised recipients.

8. Permissions and device access

The app does not request any Android permissions.

Taking or selecting photos, importing JSON backup files and exporting JSON and PDF files are handled entirely via the system dialogs of the Android operating system. The app only receives access to the content you have selected or the storage location you have specified.

The app does not access the following data or device functions:

Contacts created within “Tauschbuch” are stored exclusively within the app. They are not imported from and not synchronised with the Android address book.

9. Android system backups and device transfers

Depending on the Android version used, the device, the device settings and the technical backup configuration, locally stored app data may be backed up as part of a backup managed by the Android operating system or a transfer to another Android device.

Such a backup is not performed or managed by the provider of “Tauschbuch”. It is carried out by the Android operating system or by the backup, device or cloud provider set up on your device.

The provider of “Tauschbuch” does not receive access to such system backups.

Whether system backups are enabled and how they can be managed or deleted depends on the settings of your Android device and the terms of the respective backup or device provider.

10. Contact by e-mail

If you have questions about the app or about data protection, you can contact the provider at the following address:

tauschbuchsupport@gmail.com

The app contains a contact button. When you tap this button, the app uses a so-called “mailto:” call to open an external e-mail app installed on your device.

The “Tauschbuch” app:

Only when you send the message yourself in your external e-mail app is the data you have entered transmitted to the provider of “Tauschbuch” via your e-mail provider.

The following personal data in particular may be processed:

The data is processed to handle and answer your enquiry.

Where your enquiry serves the initiation or performance of a contractual relationship, processing is based on Art. 6(1)(b) GDPR.

For general questions, support requests or data protection matters, processing is based on Art. 6(1)(f) GDPR. The legitimate interest lies in handling user enquiries, providing support and ensuring the secure and user-friendly provision of the app.

Contacting the provider is voluntary. Without the information required for processing, your enquiry may not be answered, or not answered completely.

The provider uses a Gmail mailbox to receive and process e-mails.

For users in the European Economic Area, the provider of this service is generally:

Google Ireland Limited

When e-mails are transmitted and stored, Google and service providers engaged by Google may process personal data.

In addition, personal data may be transferred to authorities or other recipients where there is a legal obligation to do so or where the transfer is necessary for the establishment, exercise or defence of legal claims.

12. Retention period for e-mail enquiries

Personal data from e-mail enquiries is generally stored only for as long as is necessary to handle and answer the respective enquiry.

After the enquiry has been dealt with, the data is deleted, provided that:

Where statutory retention periods apply, the data concerned is stored for the duration of those periods and deleted afterwards.

13. Deletion of local data and uninstallation

If you delete individual content within the app, it is removed from the app’s local data set.

When the app is uninstalled, the data in the internal app storage is generally removed from the device.

However, data may still exist if you previously:

You must delete such files, copies and backups outside the immediate app storage yourself via the respective storage, cloud, backup or device provider.

The provider cannot delete data stored on your device or in your own backups for you, as the provider has no access to it.

14. Your data protection rights

Insofar as the provider processes personal data about you, in particular in the context of an e-mail enquiry, you have in particular the following rights, subject to the statutory requirements:

Where processing is based on Art. 6(1)(f) GDPR, you may object to the processing at any time on grounds relating to your particular situation.

To exercise your rights, you can contact the following e-mail address:

tauschbuchsupport@gmail.com

With regard to app data stored exclusively locally on your device or in your own files and backups, the provider cannot provide access, rectification or erasure, as the provider has no access to this data.

You can manage this data yourself within the app or via the respective storage, cloud or backup provider.

15. Right to lodge a complaint with a supervisory authority

Under Art. 77 GDPR, you have the right to lodge a complaint with a data protection supervisory authority if you consider that the processing of your personal data infringes the GDPR.

You may in particular contact a data protection supervisory authority at your habitual residence, your place of work or the place of the alleged infringement.

16. No automated decision-making

No automated decision-making, including profiling, within the meaning of Art. 22 GDPR takes place.
